Order

The order of the products prosposed in the on line shopping Collections Et si… depends on the buyer’s agreement, and it is equivalent to his complete agreement without any restriction, of all the conditions here exposed. This general conditions of sale are accepted by the buyer, without taking into account any special clause he would consider, except if the buyer expresses his agreement in an explicit way, and without considering any promotion presented in one of the shops of Collections Et si… The agreement of the buyer is materialized when he clicks on the « I accept » button and when he gives his bank data to pay his order. This electronic signature has the same value as a manuscript signature between the two parties.This double operation means that the buyer has read and accepted this general conditions of sale. This general conditions of sale explain the rights and obligations of the buyer towards the products sold in the on line shopping Collections Et si…The contract established in case of a final order respecting the general conditions of sale is subordinated to the Consuming French Code and to the special dispositions here presented.

Article 4 : DURATION OF THE OFFER

The offers of the on line shopping Collections Et si…are valid for each product presented on the site till this product is presented on line.


Article 5 : PRICE

The price of the products on the on line shopping Collections Et si… is in Euros. The price includes the taxes at the date the buyer accepts the offer as it is explained at article 6 hereafter. Delivery fees are indicated when the buyer validates the products that are in his cart. The price is the same that is proposed on the on line shopping Collections Et si…when the order is done as it is explained at the article 6 hereafter.The price has to be paid completely when the order is done, excepting the case the buyer changes of mind at it is explained at the article 7 hereafter. Article 6 : ACCEPTING THE OFFER

The buyer accepts the offer, when he clicks on the « I accept » button, and he accepts all the informations hereafter (some of these informations have to be completed by the buyer, specially the bank data). Last name of the buyer Name Address Adress for the delivery (if different) E-mail Phone (optional)Confirming the order: - name of the product (with its code) - quantity - price- means of payment (credit card or check) - delivery mode- delivery feeThe order of the buyer shall be confirmed on a written way by the seller, at the latest at the delivery of the products.


Article 7 : RIGHT TO CHANGE OF MIND

The buyer can change of mind within 7 days from the moment he receives the products. He can change the product or ask for a reimbursment, without any penalty, excepting the payment of the return of the product. If the buyer changes of mind, he shall send back the product with the invoice and the bank data so that the seller can reimburse him. Data bank shall be the same as the data bank given when the buyer paid the order as explained at the article 6, excepting if the buyer gives clearly a different option.The product shall be sent back at the address the seller will give to the buyer when the buyer contacts the seller at contactclients@kamaieu.com, as the address may change depending on the kind of product concerned. The fees of the return will be paid by the buyer, and the return mode shall be the same as the delivery mode (recommending package with value of the product or colissimo with an insurance if the price of the order is equivalent or more than 100 Euros). If the buyer changes of mind and respects all the conditions of this right, the seller shall reimburse the buyer as quick as possible, excepting the price of the delivery and only if the product is returned in the same package without being used or dammaged. If there is any sign that can suppose that the produt has been used or modified in any way, the right will be lost.


Article 8 : PAYMENT

The buyer has to pay by credit card or check the whole amount of his order as soon as he accepts the offer of the seller, as it is explained at the article 6, providing he doesn’t use his right to change of mind as it is explained at article 7.In the case the amount of the order is equivalent or more than 150 €, the buyer shall pay by credit card.The seller accepts all the national credit cards and Visa and Mastercard as well as checks from French banks. The buyer guarantees when accepting the offer of the seller that his bank situation is normal.As soon as the buyer gives his credit card number or sends his check to the sellers’ address, he accepts the whole amount given on the invoice.The order is registered only when the seller has received the whole amount of it.In case the payment has any problem the seller can stop the delivery or at any moment ask to get back the product.


Article 9 : DELIVERY

The product ordered is delivered by the postal services at the address given by the buyer. This address may change if the buyer asks for that option.In case the buyer is absent at the moment the product is delivered, the buyer will have to get the product wherever the post service indicates him.In case the buyer does not get the product within the time given by the post services, the product shall be sent back to the seller and the seller will reimburse the buyer as soon as possible, excepting the amount which corresponds to the forwarding. In case the products does not correspond to the order or is dammaged during the transport, the seller shall reimburse or change the product as soon as possible as it is explained at the article 11. In case the product is dammaged, the buyer shall explain his complaint writing it down on the invoice and shall send a copy of it to the seller by the postal service.For this reason, the buyer shall verify the product when receiving it. The verification shall be considered as done as soon as the buyer, or any person having his autorisation, signs the delivery document.For small products, delivery will be done within 7 to 15 days (excepting week-ends or excepting any indication given specifically on the description of the product on the on line shopping Collections Et si…). This period runs from the moment the buyer accepts the order and the seller receives the whole payment. This period is given as an example and the seller shall not be responsible of any delay. Specially in case of strikes or weather circumstances, the buyer cannot cancel the order or ask for a compensation of any kind.


Article 10 : GUARRANTEES

The buyer has the guarrantee explained at the article 1641 from the French Civil Code and in some cases a commercial guarantee for any defect of the product when it is clearly explained on the description of the product on the on line shopping Collections Et si... This guarantee shall be used only if the buyer respects the advice given concerning the use of the product and providing the buyer uses the product in a normal way. The advice shall be given to the buyer on a document given with the product.In case the guarantee can be used, the seller shall repair, reimburse or change the product as the buyer prefers, paying the new delivery.If the buyer wants to have a new product, the new product shall be the same, excepting if the product is not available any more. In this case, the buyer shall receive a product similar to the first one.


Article 11 : NOMINAL INFORMATIONS

If the buyer does not refuse by an explicit way, he accepts that the seller uses his nominal informations for the clients’ file or to give them to a third party, providing there is a contractual link between the seller and the third party. According to French law n° 78-17 from January 6th 1978 concerning information processing, files and liberties, the buyer has the right to see and change his nominal informations. If the buyer wants to do so, he shall contact the seller at Internet Service Consommateurs – Kamaïeu SARL 12, rue Clément Ader 31170 Tournefeuille-France. Concerning the bank data, the seller guarantees that he will not keep those data after the commercial operation. In any case, the payment shall be treated by the National Bank of Paris, as far as the payment on line is done using Merc@anet, the safe online payment system of this bank.


Article 12 : LAW APPLIED

This contract is submitted to the French law, specially articles L. 121-16 to L. 121-20 from the Consuming Code.


Article 13 : LITIGATION

In case of a litigation, the buyer shall first try to solve the problem directly with the seller. If the seller does not use his right in case the buyer commits a fault, it does not mean the seller refuses to use this right. In the same way, the buyer cannot understand that his obligations are not valid any more.
